DMCA Copyright Policy
In compliance with the Digital Millennium Copyright Act (DMCA), we have implemented the following policy regarding copyright infringement. We reserve the right to:
-
Block or remove any material that we have a good faith belief is copyrighted content that has been unlawfully copied, used, or distributed by any of our advertisers, affiliates, partners, content contributors, members, or users.
-
Suspend or terminate services for any user or member who is deemed a repeat infringer.
By using CraftlyHome’s services, you agree to abide by our Terms of Service, which includes this Copyright Policy. Any terms not defined in this policy carry the meanings assigned in the Terms of Service.
How to Report Copyright Infringement
If you believe that material available on or through our services infringes your copyright (or the copyright of a person you are authorized to represent), you must provide a written notice of infringement that includes the following details to our Designated Agent (see contact details below):
-
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
-
Identification of the copyrighted work(s) that you claim have been infringed.
-
Identification of the specific material alleged to be infringing, along with sufficient details (such as URLs or exact locations) so that we can locate and verify the material.
-
A statement confirming that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
-
Your contact information, including your name, mailing address, phone number, and email address (if available).
-
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.
What Happens After We Receive a Valid Notice
Once we receive a complete and proper infringement notice:
-
We will remove or disable access to the identified infringing content.
-
We will notify the content provider or user responsible for the material that their content has been removed or access disabled.
-
For repeat offenders, we may terminate their account or access to our services.
How to File a Counter-Notice
If you believe that the material removed or disabled was done so in error or that you are legally entitled to use the material (e.g., through authorization from the copyright owner, a legal exception, or fair use), you may submit a counter-notice to our Designated Agent. Your counter-notice must include:
-
Your physical or electronic signature.
-
Identification of the material that was removed or disabled and the location where it appeared before removal.
-
A statement that you have a good faith belief the material was removed or disabled by mistake or misidentification.
-
Your name, address, telephone number, and email (if available), along with a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., to any judicial district where CraftlyHome is located) and that you will accept service of process from the original complainant.
Upon receiving a valid counter-notice, we may forward it to the original complainant. Unless the copyright owner initiates legal action within 10 business days, we may restore the removed content or reinstate access at our discretion.
